The Terms and Conditions of Sobha Privilege loyalty program

Definitions:

"Company" refers to Sobha Limited, who is a leading and only backward integrated Real Estate Developer in the country, building world class residential properties.
"Sobha Privilege" refers to the loyalty program run by Sobha Limited.
"Buyer" means the person who purchases a flat/ unit/ apartment/villa (as the case may be) from Sobha Limited.
"Member" means a Buyer / Sobha customer who is automatically enrolled as a member of Sobha Privilege Loyalty Program.
"Sobha customer/s" means a person who purchases a flat/unit/apartment/villa, as the case may be, from Sobha Limited.
"Agreement Value" means the basic cost of the flat.
"Points" means the points awarded to a member for purchasing a flat/unit/apartment/villa from Sobha Limited who is participating in Loyalty Program run by Sobha Limited.
"Program Partners" refers to the persons who offer services, benefits, redemptions or any facilities and arrangements to the members of Sobha Privilege.
"Reward" is the benefit and/or reward that a member can avail of through exchange of his/her points.
“Neighbor Connect”– An option to create a network inside your sobha privilege membership portal with your close friend circle and provide them gift points from Sobha.
“Gift your Neighbor” – transfer your Sobha Privilege points as gift to a Neighbor Connect member with in sobha privilege membership, who are connected on your Neighbor Connect network.
“Payment Request Letter (PRL)” - is the letter raised by the company as a reminder to pay the outstanding.

General Conditions:

Sobha Privilege is a Program managed, developed and operated by Sobha Limited, to reward Sobha customers.
Sobha Privilege Loyalty Program membership and its benefits are offered at the sole discretion of Sobha Limited.
All communication shall be mailed to the mailing address (postal or email) and if there are any changes in the member's personal information, then it is the responsibility of the member to record his/her email address, residential address/ office address/ mailing address as well as the mobile and landline numbers in the Sobha Privilege portal under the profile section. It is the responsibility of the member to ensure that the changes are reflected in our website and system. All communication shall be deemed to have been received by the member and Sobha Limited. bears no responsibility for communication not received or lost in the mail or courier.
Any of the rules, privileges, benefits, terms, conditions, reward or reward levels or duration pertaining to the Program/ applicability of the Program may be cancelled, discontinued, withdrawn, changed, altered or modified or extended by the Company without notice and that Sobha Limited shall not be liable for loss or damage resulting there from.
Each member shall be knowledgeable about the Program Terms and Conditions and as to the number of points in his or her account. Sobha Privilege Program shall attempt to send correspondence to active members to inform them on matters, including notification of Program changes. However, neither Sobha Privilege Program, nor companies participating as Partners in the Program shall be liable for any failure to do so and shall not be responsible for incorrect or inaccurate transcription of entry information, for problems related to any of the equipment or programming associated with or utilized by the member, for any human error or for any interruption, deletion, omission, defect, or line failure of any telephone network or electronic transmission or for problems relating to computer equipment, software, inability to access any Web site or on-line service, for any other technical or non-technical error or malfunction, or for lost, late, stolen, illegible, incomplete, garbled, misdirected, mutilated or postage due mail or other mail for whatever reason.
The Program and any benefit or rewards relating to the Program, shall not be construed as, or constitute a contract, or otherwise establish a contractual relationship between Sobha Limited and any Sobha Privilege members.
Nothing in the Sobha Privilege Program is intended, or shall be construed to create or establish any agency, partnership or joint venture relationship between Sobha Limited and its Program partners.
As part of the endeavor of Sobha Limited to provide valuable information to the members of Sobha Privilege Loyalty Program, Sobha Privilege Program would develop mailing lists for use by themselves. These lists are developed under strict supervision so as to safeguard the privacy of the member's information. As part of providing value added product offering to its members, Sobha Limited reserves the right to send special offers/promotions to the members regarding Sobha Privilege.

Enrollment and Membership

An online unique membership number which will be the login ID and password shall be allocated to the buyer on booking / purchase of a Sobha Apartment/Villa. The use of this membership number and associated benefits is deemed to be an acceptance of these Terms and Conditions and other Program Terms and Conditions that may be issued from time to time, to the benefit of customers of Sobha Limited.
Sobha Privilege members cannot maintain membership in or earn points on multiple accounts.
Membership of Sobha Privilege is not transferable to any third party and may only be used by the member. A member can have only one membership number here under.
Employees of Sobha Limited are not entitled to the benefits under the Sobha Privilege Scheme.
Except as specified herein, the membership to the Sobha Privilege is valid for the lifetime of the member.
Any Sobha Privilege member can recommend connected Neighbor for any category for any Sobha projects and the point structure would be as described later.
Sobha Privilege program may be discontinued at any time, with or without notice to the members. Accumulation of points shall cease immediately on termination of the Program. However, members shall be given 3 months' time from the date the Program termination is announced, to redeem the desired reward/s.
Sobha Limited reserves the right to discontinue membership to the Sobha Privilege of any member who appears to be using the Program in a manner inconsistent with the Terms and Conditions, or the intent of the Program, or any portion of the Program, including, but not limited to, reward redemption, or, if a member commits misconduct or fraud, or misuses the Program's benefits and awards, misuses the Program of its facilities etc. Sobha Limited. also reserves the right to discontinue membership of any member who acts in a manner inconsistent with local or state laws, statutes or ordinances. Discontinued membership may result in losing all accumulated reward points and the cancellation of all Sobha Privilege rewards, benefits and privileges.
Membership number and accrued points do not constitute property of the members.

Earning and Accrual of Points

Membership to the Sobha Privilege Program entitles members to earn points, which can be redeemed for rewards in accordance with the Terms & Conditions of the Program.
Points shall be allocated only for purchases from the day the Program is launched.
Points shall be allocated to the buyer only on receipt of payment of 10% basic value of the property and/or payment of entire amount of 1st PRL (Purchase Request Letter) by the buyer and 50% of points will be assigned to connected neighbor mentioned in portal as a gift.
Privilege points does not have any monetary value, points are only redeemable with in the specified period of program.
No purchase/assignment of points is permitted. A member cannot do so in order to redeem such points for a reward.
Sobha Limited reserves the right to rectify points from a member's account if the points have been erroneously recorded under the account.
Referrers shall be entitled to points under the Loyalty Program even if the buyer he/she has referred purchasers of Sobha Apartment/Villa/Unit through some other scheme.
On resale of Sobha Apartment/Villa/Unit by the member, he/she shall disentitle to his/her points gained under Sobha Privilege Program.
In case the buyer upgrades or shifts to a higher unit in any of the Sobha Apartment/Villa/Unit, then he/she will be entitled for points depending on what category the new Apartment/Villa/Unit fall into.
Applicable taxes if any shall be collected or deducted at the time of redemption of points.
The membership is entitled to get points as per the table below

Bonus on 2nd Neighbor Connected	15% (of 2 x basic) e.g. Customer has multiple neighbor connected. One of them books a Dream Series 2 BHK and another books another Dream Series 2 BHK. Total eligibility for source customer = 1.15 X (25,000 + 25,000) = 57,500
Bonus on 3rd Neighbor Connected	20 % (of 3 x basic) e.g. Customer has multiple neighbor connected. One of them books a Dream Series 2 BHK, another books a Dream Series 1 BHK and another books Dream Series 2 BHK. Total eligibility for source customer = 1.2 X (25,000 + 15,000 + 25,000) = 78,000
On Successful Adding a Connected Neighbor	100 points
Points on Client meeting/Site Visit	150 points

Expiry of Points

The points are valid for a period of 1 year.
Upon expiry of the one year period, the accumulated points, if not redeemed, will lapse.

Rewards and Redemption

A minimum of 1 confirmed purchase of another Sobha Apartment/Villa/Unit is required for redemption. However, on receipt of 10% payment of the basic value of the property and/or payment of 1st PRL (Purchase Request Letter) from the buyer is required for enabling the redemption process for both the buyer as well as the connected Neighbor gifted.
The products or the gift vouchers shall be delivered by the Program Partners to the member's mailing address within 30 working days
In case the customer opts for a gift voucher, it shall be the responsibility of the customer to check and ensure that the gift items are purchased before the expiry date of the vouchers; failing which the voucher shall lapse.
Sobha Limited., reserves the right to exclude the products and services featured in the catalogue for redemption of the points, in subsequent editions of the catalogue, if any.
All rewards / gifts are subject to availability and supplier restrictions. Sobha Limited. may, without notice, withdraw or substitute any reward/gift for another reward/gift of comparable value and nature. In case the exact model of the merchandise mentioned in the rewards catalogue is not available at the time of redemption, an alternate model of the product which is similar in price and quality shall be made available to the member. Sobha Privilege points can be redeemed for gifts as featured in the Sobha Website.
All taxes and applicable incidental expenses shall be borne by the member unless mentioned otherwise.
Delivery of merchandise shall be an arrangement between the member and the vendor and, Sobha Limited shall have no responsibility for non-delivery / late delivery or quality of products etc.
Transportation, Installation, Courier Costs, etc, incurred with regard to redemption shall be at the sole responsibility of the member.
No credit or substitutions shall be given for any rewards that are only partially used.
Redeemed rewards/gifts once issued/delivered shall not be changed and the member shall not be entitled to any refund or credit for the points redeemed nor can these be re-converted back to points

Cancellations/Terminations

In case of cancellation/termination of a property purchased, the buyer, as well as the connected Neighbor, shall not be entitled to the points allocated to them for that particular purchase, but shall retain their respective membership numbers, if already a member. The Points pertaining to that transaction shall get automatically reversed on such cancellation/termination.
In case of cancellation/termination of a property purchase where the buyer has already redeemed his/her points pertaining to that particular transaction, then the equivalent amount that has been redeemed shall be recovered from the advance /booking amount paid towards such property purchase. But the membership number shall still be retained as it is valid for a lifetime.
No rewards point can be redeemed for cash with Sobha Limited.
All interpretations of the Terms and Conditions and Program rules shall be at the sole discretion of Sobha Limited.
In the event of any grievance/dispute of the member on the services pertaining to the Loyalty Program, the same shall be sorted out as soon as possible by way of discussions between such member and a representative of Sobha Limited. If such grievance/dispute is not sorted out to the satisfaction of the member, the decision of Sobha Limited., in respect to the Program shall be final and binding.
Terms and Conditions of Sobha Privilege and the relationship between Sobha Privilege Loyalty Program and/or Sobha Limited., and each member are governed by Indian law. By becoming a Member of the Sobha Privilege Loyalty Program, each member submits to the exclusive jurisdiction of Courts in Bangalore.
